From the 21st May,2010 - The requirement for a HIP pack is removed but EPCs are still required at the marketing stage
Amended Energy Performance of (Certificates and Inspections) Buildings Regulations 2010
Sellers and estate agents are no longer required to have or provide copies of HIPs with effect from 21st May 2010. In order to ensure that people selling their homes continue to make an Energy Performance Certificate available to prospective buyers, CLG have also laid before Parliament the Energy Performance of Buildings (Certificates and Inspections) (England and Wales) (Amendment) Regulations 2010 which introduces a number of new legal requirements on both sellers and agents including:
• a new duty on the seller to secure that an Energy Performance Certificate (EPC) has been 'commissioned' before marketing of the property commences where no such certificate is already available
• an EPC has been 'commissioned' when a Domestic Energy Assessor has been instructed to prepare the EPC and the EPC has either been paid for or has given a clear undertaking to pay for it
• a new duty on the person acting on behalf of the seller, e.g. estate agents, to be satisfied that an EPC has been commissioned before commencing marketing
• a new duty on both the seller and a person acting on their behalf to make reasonable efforts to secure an EPC within 28 days
As of April 6th 2009, property marketing cannot commence unless the HIP contains:
● A completed Index
● A completed PIQ
● An Energy Performance Certificate (EPC) or Predicted Energy Certificate (PEA)
● A completed Sale Statement
● Title Documentation (or a SIM if unregistered)
● Property searches and leasehold information must be requested and obtained within 28 days (but will not delay marketing)
This means that your customer (or their estate agent) can’t erect a ‘for sale’ board, list the property online or in the local newspaper, or do anything else that can be constituted as ‘marketing’ without the above components being completed first.
Any delay in getting these basic HIP components will prevent your customer from marketing their property, which could mean that they miss out on important viewings from serious buyers. Therefore HIP providers who can offer a speedy service will have a competitive edge.
The Property Information Questionnaire (PIQ)
A new edition to the HIP is the PIQ. Details in the PIQ will include flood risk information, gas and electricity safety, service charges, structural damage, and parking arrangements to help buyers make decisions on whether to view and purchase a property. As it is the vendor who needs to complete this form, you will need to consider how you will go about getting this form completed. Delays in getting the PIQ completed will delay the property going onto the market.
From January,2009 the unofficial "period of grace" regarding the provision of Commercial (Non Domestic) EPCs ends,the NDEPC will become mandatory and the legislation is likely to be enforced
